This policy forms part of your Agreement with us and applies to every customer, whatever you pay. Capitalised terms have the meaning given in the Core Terms. We may update this policy under Core Terms clause 5.
1. What you must not do
You will not, and will not permit your Users or, so far as within your control, your Visitors to, use the Subscribed Services to:
- break any law, or infringe anyone’s intellectual property or privacy rights;
- upload or publish content that is unlawful, defamatory, obscene, discriminatory, abusive, harassing, or harmful to children;
- upload content you do not have the rights or consents for — including images of identifiable people, and personal data belonging to third parties;
- misrepresent a place, facility, route or hazard in a way that could foreseeably put a Visitor at risk;
- introduce malware, or attempt to gain unauthorised access to Our Platform, to another customer’s data, or to any system or network;
- probe, scan or test the security of Our Platform without our prior written consent;
- reverse-engineer, decompile or disassemble Our Platform, except to the extent the law permits;
- scrape the Subscribed Services, or place automated load on them beyond normal use of a HypaMap by a Visitor;
- resell, sublicense or make the Subscribed Services available to any third party, except by making your HypaMap available to Visitors in the ordinary course; or
- use the Subscribed Services to build a competing product.
2. Confidential and unannounced content
The images, video, audio and 3D assets in a published HypaMap are served from public storage and can be retrieved by anyone with the link. Do not place content in a HypaMap that you need to keep confidential or unannounced without speaking to us first — see Core Terms clause 7.5.
3. Visitor data
Where your HypaMap collects Visitor data, you are the controller for it. You are responsible for the visitor-facing privacy notice and for any consent required under the Privacy and Electronic Communications Regulations 2003. See Core Terms clause 11.2 and the Service Facts sheet for what is collected.
4. How we enforce this
4.1 If we reasonably believe this policy has been breached, we may remove the content concerned, or suspend access to the Subscribed Services or to a particular User, under Core Terms clause 14.1.
4.2 We will act proportionately, do only what is necessary, give you notice where it is practical to do so, and restore the service promptly once the issue is resolved.
4.3 Where we can reasonably address a breach by asking you to fix it, we will do that first. We will only suspend without notice where there is a serious and immediate security, legal or safety risk.
