By accessing Our Site you confirm that you have read, understood, and accept these Terms. We may update them from time to time (see Part 12); your continued use of the Site after any update constitutes acceptance of the revised Terms.

Our Site is owned and operated by HypaMaps Ltd, a private limited company registered in England and Wales. References to "we", "us", and "our" in these Terms mean HypaMaps Ltd.

Our contact details are set out in Part 13.

Our Site is a marketing and information resource. It exists so that prospective clients, partners, and the wider public can learn what HypaMaps does, see live examples, and request a demo or get in touch.

The Site is not the HypaMaps platform itself. The platform - the interactive 3D map, the CMS, the operator dashboard, the behavioural data we process on behalf of destinations - is delivered under a separate commercial agreement between HypaMaps Ltd and the client organisation. That agreement covers data processing, service levels, uptime, support, fees, and everything else relating to the operational platform. These Terms do not replace, modify, or override that agreement.

All content on Our Site - including text, copy, illustrations, photography, screenshots, diagrams, audio, video, logos, the HypaMaps brand mark and trade dress, and the underlying source code - is owned by HypaMaps Ltd or licensed to us by third parties. It is protected by copyright, trademark, design rights, and other intellectual property laws.

You may:

• →View and read pages of Our Site for personal, non-commercial use.
• →Share links to pages on Our Site, provided you don't misrepresent or alter the content at the destination.
• →Quote short, attributed extracts of public-facing copy for the purposes of news reporting, review, or commentary, as permitted under UK copyright law.

You may not:

• →Copy, reproduce, modify, or distribute substantial portions of Our Site without our prior written permission.
• →Use the HypaMaps name, logo, or brand assets in any way that suggests endorsement, partnership, or affiliation we have not given.
• →Scrape, harvest, or otherwise extract data from Our Site by automated means (other than legitimate search-engine indexing).
• →Reverse engineer, decompile, or otherwise attempt to extract the underlying source code of Our Site or the embedded HypaMaps platform.

Third-party logos and brand marks displayed on Our Site (such as those of our clients and partners) remain the property of their respective owners. Their inclusion is illustrative of our work and does not imply endorsement of HypaMaps by those parties beyond any specific arrangement we have with them.

When using Our Site, you agree that you will not:

• →Use the Site for any unlawful, fraudulent, malicious, or harmful purpose.
• →Submit false, misleading, or impersonated information through any contact, demo, or signup form.
• →Attempt to gain unauthorised access to any part of the Site, the platform, our servers, or any system or network connected to them.
• →Interfere with the proper functioning of the Site (including denial-of-service attempts, malware, or any conduct that disrupts other visitors' use).
• →Use the Site in a way that could damage, disable, overburden, or impair it.
• →Frame, mirror, or otherwise reproduce the Site on another domain without our written permission.

We reserve the right to block access, remove submissions, or take any other action we consider proportionate where these acceptable-use rules are breached.

When you submit a demo request, contact form, or other enquiry via Our Site:

• →You agree the information you provide is accurate and that you are entitled to provide it (e.g. that the work email and organisation are genuinely yours or that you have authority to make the enquiry on their behalf).
• →We will use your information to respond to the enquiry and, where relevant, to follow up about a possible engagement. We will not add you to marketing lists without your separate consent.
• →Submitting a demo request does not in itself create a contract or commercial relationship. Any engagement following from your enquiry will be subject to a separate written agreement.

Our Site contains links to third-party websites and embeds (including the live HypaMaps client maps shown on our Client Examples page). Those resources are provided for information and illustration only.

We do not endorse, control, or take responsibility for the content, accuracy, availability, or privacy practices of any third-party website you link to from Our Site. The presence of a link does not imply our approval of the linked site or its operator.

Where live HypaMaps maps are embedded on Our Site for demonstration purposes, their availability is subject to ordinary operational conditions and we make no warranty as to their continuous availability. Embedded maps may show data that belongs to our clients; you must not extract, scrape, or otherwise reuse that data outside of legitimate viewing.

Our Site is provided on an "as is" and "as available" basis. While we take care to keep the information here accurate, current, and useful, we do not warrant that:

• →The Site will be available without interruption.
• →All information on the Site is fully up to date at all times.
• →The Site will be free of errors, defects, or harmful components.
• →Any specific outcomes will result from your visit to or enquiry through the Site.

Service-level commitments relating to the HypaMaps platform itself (uptime, response times, data availability) are set out in the separate commercial agreement entered into by our clients, not on this Site.

Nothing in these Terms limits or excludes our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot be limited or excluded under applicable law.

Subject to the above, and to the maximum extent permitted by law, HypaMaps Ltd shall not be liable to you for any indirect, consequential, special, or incidental loss arising from or in connection with your use of Our Site, including (without limitation) loss of profit, loss of business opportunity, loss of data, or loss of goodwill.

Where you engage with HypaMaps as a paying client, liability arising from the platform itself is governed by the limits and allocations set out in the commercial agreement between us, not by this section.

Your use of Our Site is also governed by our Privacy Policy, which explains how we collect, use, store, and protect personal data, and covers the limited cookie use on the Site.

By using Our Site you confirm you have read the Privacy Policy and consent to our processing of personal data in line with it.

These Terms, your use of Our Site, and any dispute or claim arising out of or in connection with them (including non-contractual disputes or claims), are governed by the law of England and Wales.

You and HypaMaps Ltd agree that the courts of England and Wales shall have exclusive jurisdiction to settle any such dispute or claim, save that we retain the right to bring proceedings against you in any other jurisdiction where you are based.

We may revise these Terms from time to time to reflect changes in the law, the way we operate, or the features available on Our Site. When we do, we will update the "Last updated" date at the top of this page. Material changes will be flagged on the Site for a reasonable period.

Your continued use of the Site after any update constitutes acceptance of the revised Terms. If you do not agree with any update, please stop using the Site.
